Landlord and Tenant Bill Scales Second Reading in Delta Assembly

Asaba, Delta State — Relief may soon come to both tenants and landlords across Delta State as the much-anticipated Landlord and Tenant Bill, popularly known as “The People’s Bill,” passed its second reading on Wednesday at the Delta State House of Assembly.

The bill, sponsored by the Leader of the House, Hon. Emeka Nwaobi, alongside thirteen other lawmakers, received overwhelming support during plenary, which was presided over by the Speaker, Rt. Hon. Emomotimi Dennis Guwor.

Leading the debate, Hon. Nwaobi, who represents Aniocha South Constituency, said numerous public complaints about unfair treatment in tenancy matters across the state inspired the bill. He explained that the bill seeks to create a fair and balanced relationship between landlords, tenants, and agents, while ensuring that everyone’s rights are protected.

Key Highlights of the Bill

Hon. Nwaobi outlined some major provisions in the proposed law:

  • Rent Increase Limit: Landlords cannot raise rent by more than 50% within three years.
  • Rent Tribunals: To be established in all local government areas to resolve disputes fairly and quickly.
  • Agency Fees: A standardised 5% agency fee will be payable by tenants to prevent overcharging.

He said the bill aims to tackle issues such as rent extortion, sudden rent hikes, and agent exploitation, which have long caused tension between property owners and tenants.

More than twenty lawmakers spoke in favour of the bill, describing it as timely, people-oriented, and reformative. They noted that the existing Rent Control Law of 1977 is outdated and no longer reflects current economic realities. The lawmakers urged its repeal and replacement with this new, modern framework.

Following the debate, members unanimously supported the bill through a voice vote. The Speaker, Rt. Hon. Guwor, then referred it to a Joint Committee on Housing, Urban Renewal, and Women Affairs and Humanitarian Support Services for further review.

In a related development, the Speaker also announced the creation of a seven-man ad-hoc committee, led by Hon. Emeka Nwaobi, to investigate the ongoing crisis between the Governing Council and Management of the Delta State Polytechnic, Ogwashi-Uku.

The committee’s formation followed a motion raised by Hon. Isaac Anwuzia (Aniocha South Constituency), who expressed concern over the deteriorating relationship between both parties. He urged the House to step in and restore peace and effective administration within the institution.

With this new bill and the Assembly’s proactive steps, Delta State appears to be moving toward fairer housing policies and stronger institutional harmony.
