Delta Govt Says “Not So Fast!” — Rector Suspension Reversed

The Delta State Government has officially cancelled the suspension of the Rector of Delta State Polytechnic, Ogwashi-Uku, Prof. Emmanuel Achuenu, declaring that the Governing Council did not follow proper procedures before taking such disciplinary action.

This decision was made known through a letter dated July 7, 2025, and signed by the Commissioner for Higher Education, Prof. Nyerhovwo Tonukari. The letter, titled “Re: Suspension of the Rector of Delta State Polytechnic, Ogwashi-Uku”, addressed serious concerns over the Council’s failure to comply with the laws and regulations guiding disciplinary actions at the institution.

According to the Commissioner, the Ministry received a letter from the Governing Council informing it of the Rector’s suspension for alleged financial misconduct and gross misconduct. However, the Ministry noted that while accountability is important, it must be pursued lawfully and transparently.

The Commissioner pointed out that no formal investigative committee was set up as required by the school’s Terms and Conditions of Service, particularly Section 6.5.1, which states that such actions must include:

  • A written query to the officer (Rector),
  • The formation of a five-member investigation panel, including:
  • 3 Council members,
  • 1 Academic Board representative,
  • 1 Congregation member of equal or higher rank than the officer.

The letter also highlighted Section 17(1) of the Polytechnic’s Establishment Law, which makes it clear that the Rector is only answerable to the Visitor (the Governor) through the Commissioner and cannot be directly disciplined by the Council without following laid down procedures.

Prof. Tonukari emphasized that any attempt to discipline a principal officer like the Rector without approval from the Visitor is invalid. He stressed that even in cases where Council members themselves are being disciplined, the power still rests with the Governor, not the Council alone.

As a result, the Delta State Government has ordered the Governing Council to immediately reinstate Prof. Emmanuel Achuenu and suspend any further disciplinary actions unless proper legal and procedural steps are taken.

“The Ministry expects full compliance with this directive in the interest of institutional integrity and the rule of law,” the letter concluded.

This development sends a strong message that no arm of an institution is above the law, and due process must always be followed — especially in matters involving leadership and public accountability.
